Undeclared swimming pools: details from Bercy on the “bugs” of the software – Better Living Your Money

The tax administration sheds light on the errors of its artificial intelligence software, which is currently only ” at the experimental stage ».

If the software of the tax administration which makes it possible to detect by aerial view the undeclared swimming pools is not without bugs, the situation is to qualify, according to Bercy. As a reminder, nine departments (Alpes-Maritimes, Var, Bouches-du-Rhône, Ardèche, Rhône, Haute-Savoie, Morbihan, Maine-et-Loire and Vendée) have set up this device since the beginning of 2021. But this one is only at the “experimental stage”reassures the Directorate General of Public Finances (DGFiP), which wishes to point out that it is not properly developed with Google and Cap Gemini, as mentioned in the press. “The tool is developed internally at the DGFiP, which alone handles the data and actions towards taxpayers. The call to Cap Gemini and Google is made on certain bricks which are open source. It is therefore incorrect to say that it is developed by these two providers »says Bercy.

No redress letters

What about the fate of taxpayers who received an overflow of property tax because of these calibration errors, for some who doubled the note ? ” At this stage of the experiment, it is information request letters that are sent to taxpayers and not adjustment letters.. A detail that is important, according to the tax authorities. “It is a phase of dialogue (adversarial procedure) which allows users to confirm or invalidate the information retrieved via this tool. It will take several more weeks. It is at the end of this dialogue that the taxation (or non-taxation) will be notified., we underline in Bercy. In concrete terms, taxpayers who consider themselves aggrieved will therefore have “still the possibility of contesting and making a complaint ».

The administration recalls that the tool is based on the principle of artificial intelligence (AI), which “learns and grows as you go. It is therefore normal for there to be adjustments, especially during the experimentation phase. The AI scans have therefore been verified by agents, which is an integral part of the process. ». Clearly, it is this work that is currently being carried out that makes it possible to correct errors and ensure that AI learns and improves. The algorithm only intervenes at the margin in the calculation of the tax. “For the calculation of the tax, the administration retains the surface declared by the owner, or, in the absence of declaration, the surface calculated by an operator in support of the aerial shot. The surfaces calculated by the algorithm are therefore not retained for the calculation of the tax. ».

Errors, but which do not prefigure “final performance of the tool”

If in the nine departments where the software is tested, the error rate reported is estimated at 30% according to the unions, this percentage of error “varies according to the departments » borntherefore does not at all prefigure the final performance of the tool »assures Bercy.

“Let’s not get the wrong subject,” continues the DGFiP. The objective of this tool is to track undeclared swimming pools and fraudsters in bad faith, which penalize all those who are in good standing. The taxpayer in good faith and whose swimming pool does not have to be declared is obviously not covered by this device ». A report on this experiment in these nine departments should be presented by the end of the first half of 2022.
